Your licence to use the Website

The Website is published by Find My Local Limited (“we”, “us” or “our”), and content on the Website is protected by copyright, trademark, and other laws. As between you and us, we own and retain all intellectual property rights in such content. However, in the spirit of collaboration and to respect your ownership, we license you to use the Website under these terms:

  • You may manually access the Website and, where applicable, make a copy of the results of any searches made via the Website, using those results for personal use only. No such access, copying, or use is permitted for the purpose or in the course of any business, or for the creation of your own database.

  • All material you download or print must retain any trademarks and copyright notices as they appear on the Website.

  • Apart from using the Website under this license or any fair dealing under the Copyright Act 1994 (a New Zealand law), no material from the Website may be searched, printed, downloaded, copied, republished, or distributed in any way without our prior written permission.

  • You will not submit queries to the Website for the purpose of obtaining information about the Website, its ontology, structure, or contents.

  • You will not use the Website or any of its content in any manner that is, or is likely to be, in breach of any law, or damaging or disruptive to the Website or any other website.

Content Submission and Usage:

By submitting content to Find My Local, the listing owner acknowledges and agrees that they are solely responsible for the accuracy and legality of the provided information. The listing owner retains ownership of their content; however, they grant Find My Local a non-exclusive, worldwide license to display, promote, and distribute the submitted content on the platform. Find My Local may use the content for promotional purposes but will seek explicit permission from the listing owner before any such usage occurs.

Automated searching by public search engines only:

Automated searches may only be carried out by public search engines to index the Website. We may prohibit access by any search engine at any time.

Information provided by us:

The Website may include information intended as a guide to assist you when making decisions about advertising. If you have any further questions, please email us at info@findmylocal.nz.

Listing approval & removal

  1. Listing Approval:
    • The website owner retains the discretion to approve or reject listings submitted by users.
    • Considerations for approval may include the genuineness of the business, its capability to service customers, and alignment with the Find My Local’s brand.
  2. Listing Removal:
    • The website owner retains the discretion to remove a listing under the following circumstances:
      • – The business has been involved in controversial or criminal activities.
      • – The listing contains inappropriate material.
      • – The listing owner is found to be in breach of copyright or trademark rules and regulations.
      • – The decision to remove a listing is at the sole discretion of the website owner.
  3. Communication Expectations:
    • The website values excellent communication, and listing owners are expected to respond to enquiries within a reasonable timeframe.
    • If a listing owner fails to respond to correspondence within 5 days, their listing may be subject to removal from the site.
    • No refunds will be given if a listing is removed due to a breach of communication values. If users are not contacted within 5 days of communicating with a listing please email the platform info@findmylocal.nz.
  4. Notification and Resolution:
    • In the event of a listing rejection or removal, the website owner agrees to make contact with the listing owner to explore potential solutions or provide reasons for the decision.

User content

  1. The Website may provide a facility for users to submit content, including but not limited to ratings and reviews of businesses and their products and services. You warrant that in submitting any content to us for inclusion in the Website:
    • –  you own all rights, title and interest in and to such content
    • –  such content does not contain anything that is, or may be considered to be, defamatory, offensive, false or misleading, harassing or threatening, a breach of any law, or a breach of any third party’s rights;
    • – such content does not contain any viruses or any kind of malicious code whatsoever.
    – By submitting content, you grant us the right to use it for promotional purposes on our website and across all marketing channels, including social media. We value your original work, and if we ever consider modifying the content for marketing purposes, we will seek your permission before doing so We want to assure you that we will not share your data with any third parties While users are encouraged to follow copywrite and trademark laws when submitting content, the platform has the right (but not the obligation) to check, edit, keep from being published, or remove any submitted content for any reason or no reason at all. However, the platform is not responsible for actively checking whether the content complies with the rules. Listing pricing and payment

  1. Find My Local operates as a creator marketplace where creators and creative businesses across various categories, including Art & Craft, Digital, Food & Beverage, Fashion & Beauty, Entertainment, Māori & cultural, Performing Arts and Sustainable, can create listings. Government agencies, charitable trusts, tertiary institutions, or other organisations seeking to connect with creators may be required to pay a fee based on a case-by-case basis.

    Early Adopter Pricing:

    As part of our early adopter program, government agencies, charitable trusts, and tertiary institutions may be eligible for a discounted fee of $200 for a 5 year subscription per location for physical locations or $200 for a 5 year subscription per discipline/art form/category of educational courses or services offered by the organisations/institutes. After the early adopter period, pricing will be determined based on the value the platform brings to the organisation, considering factors such as size and services provided.

    Creator and Creative Business Pricing:

    For creators and creative businesses providing products and services, there is an early adopter fee of $100 for a 5 year subscription until the launch of Find My Local’s social media channels. After the launch, pricing plans will be updated and standard pricing will apply.

    Payment Terms:

    All fees are payable in advance, refer to our refund policy for refund terms and conditions. Payment methods accepted are bank transfer and Stripe. If you wish to pay by an invoice reach out to us on our “Contact Us” page or send an email to info@findmylocal.nz. 

    Changes to Pricing:

    Find My Local reserves the right to modify pricing and payment terms at any time. Notice of any changes will be provided to affected users in a minimum of 4 weeks in advance.

    By accessing or using the Find My Local platform, you agree to abide by these pricing and payment terms.

Availability

We do not guarantee that access to the Website or any other service we provide via the Website will be continuous or fault-free. We may modify the Website, or withhold, suspend or restrict any service provided via the Website, at any time without notice. The Website is provided on an “as is” basis and Find My Local makes no warranty that it will be free from viruses or any kind of malicious code whatsoever.

Exclusion of liability

To the fullest extent permitted by law, we exclude any liability we may have to you relating to your use of the Website, or its availability. This exclusion also applies for the benefit of each of our related companies, and all our officers, employees, contractors and agents (and those of our related companies). None of these people are liable to you or have to pay you for anything caused by or resulting from your use of the Website. This exclusion applies whatever you are claiming for and however liability arises or might arise if it were not for this clause.

Indemnity

You agree to release us from, and indemnify and hold us harmless against, all actions, claims, costs and expenses (including legal costs and expenses), losses, proceedings, damages, liabilities or demands suffered or incurred by us arising out of or in connection with your failure to comply with these terms , your breach of any warranty in these terms, your failure to complete a transaction, or your purchase and/or use of any product or service provided by any advertiser on the Website, including any actual or threatened claim in relation thereof.

Changing these terms

We may change these terms by adding, changing or removing terms at any time. Any change applies from the time it is published on our Website. You should check from time to time to see if these terms have changed, we will also end an email to all registered users of any changes 1 week prior to making changes.

Assignment

We WILL NOT assign or otherwise transfer this agreement, or any of our rights, benefits or obligations under these terms or any other agreement with you, in whole or in part, to any related company or third party.

New Zealand law applies

The Website is located in New Zealand and all services we provide via the Website are provided in New Zealand under New Zealand law. You may take action against us only in a New Zealand court. This applies whether you are using the Website from inside or outside New Zealand.

We’re excited to have you as part of our community. Find My Local is a platform that connects local creators, creative businesses, organisations that support the creative section and customers. To ensure a positive and respectful environment for everyone, please follow these community guidelines:

1. Respect Each Other

Treat fellow users, businesses, and the Find My Local team with respect and kindness. Everyone has a unique perspective, and we encourage diverse voices and experiences.

2. Be Honest and Authentic

Provide accurate and genuine information in your listings. Misrepresentation or false information can harm trust within the community.

3. Promote Local Creators & Businesses Responsibly

Support local businesses by sharing positive experiences and constructive feedback. Avoid posting harmful or negative content that could adversely impact a business’s reputation. If there is any cause for concern reach out to us at info@findmylocal.nz.

4. Respect Intellectual Property

Respect the intellectual property rights of others. Only upload content, including images and text, that you have the right to use. Do not plagiarise or violate copyright and trademark laws.

5. Use the Platform Responsibly

Ensure your use of the website aligns with our terms of use. Refrain from any activity that could harm the functionality, security, or integrity of Find My Local.

6. Maintain User Privacy

Violating these guidelines may result in warnings, content removal, or account suspension. Repeated violations may lead to permanent account termination.
