These Creator Terms apply in addition to our general Website Terms & Conditions. If there is any inconsistency between the two, these Creator Terms will prevail for matters relating specifically to creators and revenue sharing.

These Terms & Conditions (“Terms”) govern your participation as a Creator with Find My Local, a social enterprise that celebrates Kiwi culture by connecting users with local businesses, experiences, people, and organisations across Aotearoa. Our mission is to uplift the food, places, activities, creativity, and services that reflect the unique spirit of New Zealand — while empowering both young and old to earn income online.

By submitting content, joining the Creator Programme, or granting permission for your content to be used, you agree to these Terms.

1️⃣Definitions

“Find My Local”, “we”, “our”, “us”
Means Find My Local Limited and its authorised partners.

“Creator”, “you”, “your”
Means a person who provides content to Find My Local and participates in the revenue-share programme.

“Content”
Means photos, videos, audio, captions, or other creative material you submit or approve for use.

“Commission”
Means the amount paid to Find My Local by an operator or affiliate partner for each completed booking (usually 10–25%).

“Advertising Revenue”
Means revenue generated when your content is used to create a Find My Local listing, which may include hosting video files on YouTube or using images within a listing. You earn 50% of all advertising placements within that listing.

2️⃣Your Licence to Find My Local

By submitting content (or approving its use), you grant Find My Local a non-exclusive, royalty-free licence to:

• – use, display and distribute your content if it has been developed into a Find My Local listing

use your content across the platforms you select

• – make reasonable edits such as cropping, resizing, colour correction, or adding branding

• – sublicence approved content only to the operator associated with the activity/tour/business featured in the content

You retain full ownership of your content.

This licence continues until you revoke it in writing.
Revoking your licence does not affect any commission or advertising revenue already earned.

3️⃣Platform Selection

Creators may choose which platforms their content may appear on, including:

• – Instagram

• – Facebook

• – TikTok

• – YouTube

• – Pinterest

• – FindMyLocal.nz

• – Email newsletters

• – Paid advertisements

• – Other platforms selected by you

We will only use your content on the platforms you have approved.

If a third party requests to use your content for advertising or commercial activity, a separate contract will be created for your approval.

4️⃣Content Used in Listings & Advertising Revenue

If your content is selected to be used in a Find My Local listing, this may include:

• – video files uploaded to and hosted on YouTube

• – images used inside a listing

• – a mix of video clips and images presented as a promotional package

When advertising appears on your listing:

➤ You earn 50% of all advertising revenue.

This revenue:

• – will appear in your monthly creator tally

• – will be paid out the following month, after the advertising campaign has finished and once you have submitted your invoice

5️⃣Creator Commission Structure

You earn 50% of the commission received by Find My Local for bookings generated through your content.

Examples:

• – 20% commission on a $200 booking → FML earns $40 → you receive $20

• – 10% commission on a $300 booking → FML earns $30 → you receive $15

Commission is paid on bookings tracked through:

• – affiliate partner dashboards

• – creator-specific call-to-action links

• – social media posts and Find My Local listings that drive bookings

6️⃣Payment Timing

You will be paid within 10 business days after:

1. 1. the customer’s activity/tour has been completed or

2. 2. any advertising campaign connected to your listing has been completed

3. 3. AND your monthly invoice has been submitted

On the first day of each month, you will be able to see:

• – completed tours and activities from the previous month

• – completed advertising campaigns

• – commission and advertising totals

• – all earnings ready to be invoiced

All creators may participate from any country.

All creators must have a Stripe account.

Minimum payout: $5 NZD (smaller amounts roll over).

7️⃣Your Responsibilities

You confirm that:

• – You are the copyright owner of all content you provide.

• – You will NOT submit content that belongs to someone else or claim someone else’s content as your own.

  •    – If you do so, YOU are responsible for all legal consequences. Find My Local accepts no liability.

• – If minors appear in your content (under 16), you are their parent or legal guardian.

• – All descriptions and statements you provide must be truthful.

We strongly recommend that creators:

• – seek advice from an accountant

• – consider using services like Hnry or similar for tax support

• – seek advice on whether to operate as a sole trader or limited liability company

• – be aware that income may affect Working for Families / family tax credits

We also recommend you obtain appropriate business or contractor insurance, as Find My Local cannot be held responsible for personal tax, legal, or financial matters.

8️⃣Use of Your Name/Handle

You give Find My Local permission to:

• – credit your name or handle

• – tag you in posts where your content is used

We do not claim ownership of your content.

9️⃣Removal of Content

You may request that your content be removed at any time.

Upon revoking permission:

• – all of your content will be removed, except content that you have SOLD a licence for.

• – If you have sold a licence to a business through Find My Local, you must refund the licence fee before all content can be removed.

Bookings already made through your content will still be processed and paid.

1️⃣0️⃣Liability

Find My Local is not responsible for:

• – cancellations or changes made by operators

• – downtime or changes on third-party platforms

• – advertising performance fluctuations

• – changes in operator commission rates

• – delays due to incorrect payment details

• – any legal issues arising from creators submitting content they do not own

Our maximum liability is limited to commissions and advertising revenue owed.

1️⃣1️⃣Termination

We may suspend or terminate your creator account if you:

• – breach these Terms

• – submit content you do not own

• – misuse tracking links

• – engage in abusive, harmful, or fraudulent behaviour

You will still be paid any commissions and advertising revenue owed.

1️⃣2️⃣Updates to These Terms

We may update these Terms from time to time.
You will be notified of major changes.

1️⃣4️⃣Acceptance of Terms & Legal Agreement

By submitting the Creator Agreement Google Form and selecting “I agree”, you acknowledge that:

1. 1. You have read and accept all Terms & Conditions.

2. 2. This is a legally binding agreement under the NZ Electronic Transactions Act 2002.

3. 3. You confirm all information provided is accurate.

4. 4. This agreement protects both your rights and Find My Local’s rights.

5. 5. Your digital acceptance has the same effect as a handwritten signature.

If you do not agree, do not submit the form.

PLAIN-ENGLISH SIMPLE SUMMARY

This is a simple summary only. The full Terms apply.

✔ You own your content.

You give us permission to use it only on the platforms you choose.

✔ You earn money in two ways:

1. 50% commission from bookings made through your content

2. 50% advertising revenue if your content becomes its own Find My Local listing (images and/or video)

✔ You choose where your content is posted.

Instagram, TikTok, YouTube, Pinterest, etc.
We never post anything you haven’t approved.

✔ You get paid monthly.

On the 1st of each month, you will receive an email with: 

• – completed tours/experiences

• – any completed advertising campaigns

• – your earnings total for the month

You submit one invoice → paid is made within 10 business days.

✔ You must own your content.

Do NOT upload content you didn’t create.
If you lie or misuse content, you are legally responsible.

✔ If kids appear, you must be their parent/guardian.

✔ Removing your content

You can revoke your permission anytime.
All content will be removed unless you sold a licence (then you must refund the licence fee).
Bookings already made will still be paid.

✔ Business + tax

We recommend:

• – getting advice on being a sole trader vs a company

• – using Hnry or similar services

• – being aware of Working for Families impacts

• – getting basic business/contractor insurance

✔ Your agreement is legally binding

Ticking “I agree” forms a legally valid contract.
